This allegation cannot serve as a basis to set aside a Writ. At best it may constitute an issue for trial and defence if proven at the trial. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">That the 1<sup>st</sup> to 10<sup>th</sup> defendants do not owe the Plaintiff and neither has the Plaintiff provided nor performed any services for the 1<sup>st</sup> defendant or the 10<sup>th</sup> defendant. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">This, in the opinion of the court, may serve to cause them to be joined on the statement of claim for trial but certainly it cannot serve as a basis for the setting aside of the writ.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">Whether or not the writ raises a claim in rem or in personam against the 1<sup>st</sup> defendant and the 10<sup>th</sup> Defendant is an issue that may be tried but not a ground to set aside the writ of summons.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0in;margin-bottom:.0001pt;text-align: justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:"Times New Roman"">In the opinion of the court no legal reason has been generated for the setting aside of the writ of summons and none has been put forth for the discharge of the warrant of arrest of the vessel in question.
