It seeks an order of the court for a warrant to the Ghana Police Service to assist the applicant bank to possess and realise House Number 25/H/AT Korkordjor Street Mandela, New Weija, Accra and also an order for the reserved price for the auction sale of House Number 25/H/AT Korkordjor Street Mandela, New Weija, Accra. Attached to the motion is an affidavit and a number of exhibits in support of the application.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">After the service of the motion on them, the respondents filed affidavits in which they oppose the application brought by the applicant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The applicant says, by its affidavit, that the 1<sup>st</sup> respondent applied for a loan of GH</span><span style="font-size:12.0pt;line-height:115%; font-family:"Times New Roman","serif"">₵</span><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">1.3m from the applicant as a result of which the 2<sup>nd</sup> respondent used his personal property</span><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif""> </span><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">House Number 25/H/AT Korkordjor Street Mandela, New Weija, Accra as security and also executed a personal guarantee for the repayment of the facility. The applicant says that after the execution of the facility agreement it disbursed the sum of GH</span><span style="font-size:12.0pt;line-height:115%;font-family:"Times New Roman","serif"">₵</span><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">1.3m to the 1<sup>st</sup> respondent to be repaid within a term of 24 months at a rate of interest of 24% per annum. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The applicant further says that the respondents have defaulted on their obligation to repay the loan granted the 1<sup>st</sup> respondent and that notwithstanding demand letters written to the respondents their obligations under the contract remains unfulfilled. The applicant therefore seeks the order of the court to possess the mortgaged charged which had been duly registered with the Collateral Registry of the Bank of Ghana.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The respondents have indicated their opposition to the instant application and have deposed in their affidavit that the 1<sup>st</sup> respondent is not indebted to the applicant stating also that the applicant failed to disburse the loan to the 1<sup>st</sup> respondent. The respondents say that notwithstanding a charge an amount of GH</span><span style="font-size:12.0pt;line-height:115%; font-family:"Times New Roman","serif"">₵</span><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">30,000.00 by the applicant to enable it procure an indenture in the name of the parties, till date the said indenture has not been procured by the applicant as a result of which the property has not passed to the 1<sup>st</sup> respondent and thus frustrating the business of the 1<sup>st</sup> respondent.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The respondents have also deposed that the applicant purchased building materials and deposited them on the said land without the consent of the respondent. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">Indeed, the applicant has filed a supplementary affidavit in an attempt to answer the depositions made by the respondents in their affidavit in opposition. However, the court is of the opinion that given the depth of the affidavit in opposition, this case cannot be determined solely on the affidavit evidence placed before the court and that in order that this matter is effectively and decisively disposed of, it will be in the interest of justice for issues to be joined and oral evidence elicited from the parties in order to determine the contentious issues raised by the parties. Accordingly, the court will order the parties to draw out the issues as they flow from the affidavits filed and set them down for trial. The parties will be given 7 days to set the issues down for trial.
