This averment by the Plaintiff has been admitted by the Defendant in paragraph 2 of their statement of defence.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">Hence, the business of the Plaintiff is not governed by the Money Lenders Act, 1941, CAP 176 but by the Specialized Deposit-Taking Institutions Act, 2016, Act 930. Section 1 (1) states that: <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">1. Application of this Act<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">(1) This Act applies to-<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"> (a) banks;<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"> (b) specialised deposit-taking institutions;<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial"> (c) financial holding companies; and<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:1.0in;text-align:justify;text-indent: -.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">(d) affiliates of banks, specialised deposit-taking institutions and financial holding companies.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">It means therefore that Order 59 rule 2 which requires certain endorsement to be made on writ issued by money lenders does not apply to the Plaintiff herein.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The Court has examined the writ of summons issued by the Plaintiff and the Court has formed the opinion that the writ does not infringe the provisions of Order 59 rule 3 and even if it does, that per se cannot nullify or render the writ invalid in view of the provisions in Order 81 rule 1 (1) of the High Court (Civil Procedure) Rules, 2004 CI 47.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">Moreover, the trial has commenced and the court is ongoing and the concerns raised do not go to the jurisdiction of the court to hear the matter. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">Further, the Defendant has taken several steps after the irregularity complained of had come to their notice such that it is too late in the day to complain.
