The Application is supported by an affidavit <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The plaintiff/respondent is opposed to the application and has deposed to an Affidavit in Opposition that at the time of the issuance of the writ, the lawyer was licensed to practice as a lawyer in the jurisdiction.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">It is correct from the endorsement on the writ that instead of stating the name of the lawyer as being the solicitor for the plaintiff, the lawyer stated the name of the lawyer’s company as being the solicitor for the plaintiff as well as the solicitor’s Practising licence number. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">Exhibit 2 attached to the affidavit in opposition shows clearly that the said solicitor’s practice licence number quoted on the writ was issued to one Alfred Kingsley Bannerman-Williams on the 5<sup>th</sup> February 2016. From the evidence therefore it is clear that the writ was issued by a lawyer who was at the time licensed to practice law in Ghana in accordance with section 8(1) of the Legal Profession Act, 1960, Act 32 which provides that <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">8. Practising certificate<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">(1) A person, other than the Attorney-General, or an officer of Attorney-General’s department, shall not practise as a solicitor unless that person has in respect of that practice a valid annual solicitor’s licence issued by the Council duly stamped and in the form set out in the Second Schedule.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">The requirement for the name of the lawyer who issued the writ to be stated on the writ is not specifically expressed in Order 2 of the High Court (Civil Procedure) Rules, 2004, CI 47 but it is implicit from the provisions of Order 2 particularly rule 5 of Order 2. In the opinion of this court an amendment granted under Order 16 rule 7(1) of CI 47 will enable the real issue in controversy between the parties to be determined. The said rule provides that:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:.5in"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">7. Amendment of other documents<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:.5in;text-align:justify"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua","serif"; mso-bidi-font-family:Arial">(1) For the purpose of determining the real question in controversy between the parties or of correcting any defect or error in the proceedings, the Court may, at any stage of the proceedings either of its own motion or on the application of any party, order any document in the proceedings to be amended on such terms as to costs or otherwise as may be just and in such manner as it may direct.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua","serif";mso-bidi-font-family:Arial">In the opinion of the court therefore in order to determine the real issue in controversy it will be more in the interest of justice that the plaintiff be granted leave to amend the writ by stating the name of the solicitor who issued the writ. Accordingly, the court will grant leave to the plaintiff to effect the amendment within 7 days from today instead of striking out the entire writ.
