However, the land carved out for the plaintiff is occupied by the defendants who are described by him as squatters whilst the second defendant submitted that he and the other defendants are on the land with the consent of the Bolgatanga Municipal Assembly for which reason they pay the relevant market tolls to the Assembly. Plaintiff asserted that all efforts to have vacant possession of the disputed land have proved futile as the defendants have refused to vacant same and are determined to continue to occupy the land unless ordered by this honourable court to give up vacant possession.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">In a six-paragraph statement of defence filed on behalf of the forty-four defendants, they denied being squatters on, nor unlawfully occupying the disputed land. At the hearing, the 2<sup>nd</sup> 7<sup>th</sup> and 41<sup>st</sup> defendants, out of the lot, appeared and testified. The 2<sup>nd</sup> defendant said he gave evidence for himself and on behalf of the 4<sup>th</sup> defendant. The rest of the defendants, though represented by a lawyer, made no appearance at the court.&nbs
