I have also heard from Counsel for both parties as they addressed the court orally, setting out before the court the various positions held by their clients. I have given attention to the case law, the authorities and the principles governing the grant or refusal of such an application.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:108.0pt;text-align:justify;text-indent: -108.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="margin-left:108.0pt;text-align:justify;text-indent: -108.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""> The C.I 47 gives the court against whose decision an appeal has been filed a discretion to either grant or refuse the application a Stay of Execution. The fundamental principle to be considered in granting a Stay of Execution requires the applicant to allege and prove by affidavit special circumstances why the application should be granted, such as the destruction of the subject matter in issue before the appeal is determined or that the Applicant would suffer irreparable loss or the appeal would be rendered nugatory if successful.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:108.0pt;text-align:justify;text-indent: -108.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="margin-left:108.0pt;text-align:justify;text-indent: -108.0pt;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""> I have reviewed the affidavit filed in support of the application and also considered the arguments of Counsel for Applicant and I am convinced that there are no exceptional circumstances proffered before the court that would warrant the court to exercise its discretion in favour of the Applicant. The application would therefore be dismissed. However, on the affirmation by Counsel for Plaintiff/Respondent, the court will order the judgment/creditor to give an Undertaking to the court and to the Applicant stating that the judgment debt so paid to it will be promptly refunded to the Applicant should the appeal be successful.
