Each party has his/her own version.<b><o:p></o:p></b></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:81.75pt"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin; mso-ansi-language:EN-GB">The facts of the case as narrated by</span><span lang="CY" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin"> the Plaintiff/Appellant is that she got married to the 1<sup>st</sup> Defendant/Respondent in the year 1963 under the Ashanti Customary Law at the time the 1<sup>st</sup> Defendant/Respondent was serving in the Ghana Armed Forces and the Plaintiff/Appellant was a seamstress and a businesswoman as well. After their marriage, they lived shortly in Kumasi and thereafter left for Burma Camp in Accra with the family. Whilst in Accra, the 1<sup>st</sup> Defendant/Respondent left for middle east for peace keeping mission while she was in Ghana taking care of their children working and paying for their children school fees.</span><b><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin; mso-ansi-language:EN-GB"><o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="CY" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin">When the Defendant/Respondent returned from the middle East, they continued to live in Accra and in the year 1974 she and the 1<sup>st</sup> Defendant/Respondent put their resources together and acquired Plot No. 18 Block J Kaase-Kumasi for the purpose of putting up a dwelling House. While in Accra, they began the construction of their dwelling House on the plot with the Plaintiff/Appellant contributing substantial amount to put up the house and built the disputed House up to the roofing level and roofed same after which the 1<sup>st</sup> Defendant/Respondent was assigned or posted to Egypt on Diplomatic duties with all the family including the Plaintiff/Appellant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="CY" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin">According to the Plaintiff/Appellant she lived with the 1<sup>st</sup> Defendant/Respondent as a couple after the marriage, until 1982 when they returned to Ghana in the year 1982 and the 1<sup>st</sup> Defendant/Respondent retired from active service from the Ghana Armed Forces and went on pension. At that time they were all living at Ahinsan when the disputed house had not been completed. However, they moved into the disputed house partially completed and whilst living in the house, the Plaintiff/Appellant worked and procured funds for the continuation of the construction of the House until it was finally completed.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="CY" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Calibri Light";mso-bidi-theme-font:major-latin">It was Plaintiff/Appellant’s case that in 1974, she put her resources together with that of the 1<sup>st</sup> Defendant/Respondent to purchase the disputed land for the purpose of putting up a dwelling house. The Plaintiff/Apellant further states that the 1<sup>st</sup> Defendant/Respondent used her name on the documents covering the disputed property for and on behalf of both of them.
