However, the negotiations had not been concluded when her employment was unilaterally terminated by the Respondent.</span><span lang="EN-GB" style="font-family: Helvetica, sans-serif;"><o:p></o:p></span></p> <p class="MsoNormal" style="margin-bottom:10.0pt;text-align:justify;line-height: 18.4pt;mso-layout-grid-align:none;text-autospace:none"><span lang="EN-GB" style="font-family: "Book Antiqua", serif;">The Petitioner petitioned the Appellant on the ground that whilst negotiations were ongoing between the parties regarding the terms for mutual separation and bringing the Petitioner’s employment relationship with the Respondent to an end, the Respondent abandoned the negotiation process by terminating Petitioner’s employment. The negotiation process, the Petitioner claims, was done in accordance with an established practice pertaining in the Respondent Bank. The Petitioner therefore considered the unilateral termination as unfair and discriminatory.</span><span lang="EN-GB" style="font-family: Helvetica, sans-serif;"><o:p></o:p></span></p> <p class="MsoNormal" style="margin-bottom:10.0pt;text-align:justify;line-height: 18.4pt;mso-layout-grid-align:none;text-autospace:none"><span lang="EN-GB" style="font-family: "Book Antiqua", serif;">The Appellant ruled in favour of the Petitioner and made an award. The Respondent by a letter informed the Appellant of its intention not to comply with the order.
