Before hearing of the matter could commence, counsel for the Defendant/appellant raised the issue of the capacity in which the 1<sup>st</sup> plaintiff/respondent had brought the action as stated in their pleadings. Evidence was taken on the issue and by a ruling delivered on 3<sup>rd</sup> November 2017, the court found that the plaintiff/respondent had the requisite capacity to institute the action.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-weight:bold"> <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-weight:bold">It is on record that the defendant /appellant appealed against the 3<sup>rd</sup> November 2017 ruling by a notice of appeal dated 17<sup>th</sup> November 2017 and this court by a judgment dated 16<sup>th</sup> May 2019 affirmed the High Court’s position that the plaintiff had capacity to bring the present action.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-weight:bold"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span lang="EN-US" style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-weight:bold">Counsel for the defendant/appellant after the ruling of 3<sup>rd</sup> November 2017 filed a motion to interrogate the capacity of one of the lawyer handling the case for the plaintiff.
