They brought suit against the first and second defendant/respondents (hereafter referred to as the first and second defendants) seeking inter alia: a declaration of their family’s title and ownership of land situate at Suhum/Akwadum road or Agyemkumhene Akura; recovery of possession thereof; recovery of possession of a house described as numbered EF/A140 Effiduase, and a perpetual injunctive relief</span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif"> </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family: "Book Antiqua",serif;mso-bidi-font-family:Arial"><span style="mso-spacerun:yes"> </span>restraining the defendants and their privies from entering the land or doing anything thereon inconsistent with their ownership thereof. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-CA" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">In their pleading, the plaintiffs alleged that the first defendant who had been appointed caretaker of properties acquired by the said Nana Agyekumhene (deceased), had wrongfully sold land forming part of the estate to developers.
