The plaintiff, the brother of the late Kingsley Kwadwo Boakye and his customary successor, commenced an action at the court below against the legal representatives of the late Kingsley Kwadwo Boakye: his widow and son respectively as first and second defendants. The suit sought <i style="mso-bidi-font-style:normal">inter alia,</i> a declaration that house No. J2 Abenase near Oda, called Kyerewaa Villa, <a name="_Hlk8242767">was the property of the family of Maame Yaa Kyerewaa alias Maame Yaa Anyanyan,<span style="mso-spacerun:yes"> </span>damages for trespass, as well as an injunctive relief against the defendants and their privies. <o:p></o:p></a></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">It was the case of the plaintiff that the house the subject matter of the suit, was the property of Maame Yaa Kyerewaa, mother of the plaintiff and eleven others including the deceased Kingsley Kwadwo Boakye. He alleged, that although the house referred to as Kyerewaa Villa was put up by his late brother Kingsley Kwadwo Boakye, he constructed it for their deceased mother Maame Yaa Kyerewaa, on a portion of land acquired by her, and that the house was named Kyerewaa Villa in her honour. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The plaintiff recounted that around 1979-1980, the Abenase Town Development Committee was set up for the purpose of ensuring the development of the <span style="mso-spacerun:yes"> </span>Abenase town. The said Committee demarcated the area of land into plots, and allocated same to the town’s citizens upon their application. The plaintiff alleged that although each individual was allocated one plot of land, their mother Maame Yaa Kyerewaa had applied for the allocation of twelve plots of land to her, because she had twelve children. He averred that the Town Development Committee, unwilling to give her so much land, and yet recognizing the large size of her family, granted her six plots of land instead. <span style="mso-spacerun:yes"> </span>For this allocation, Maame Kyerewaa allegedly presented drinks and a token amount of money to the grantors. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-US" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;li
