At the time, three different interests had been noted in the records of the Lands Commission and the courts respectively, over the same piece of land. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The first was a gift of the land by one Nii Odai Ayiku to the 1<sup>st</sup> Defendant Appellant (1<sup>st</sup> Appellant). It was dated 23<sup>rd</sup> September 1973. The second was a gift of the same piece of land by the same Nii Odai Ayiku to a certain C ..Asamoah dated September 1975. The third interest was a Circuit Court judgment over a wider piece of land in which the land is included. The judgment was titled Nii Kotey Amli iii v Rebecca Kufuor with suit number CCL 67/89. It determined that proprietary interest in the stretch of land which was the subject of the suit stood in the La Klanaa Quarter. The judgment was also been registered with the Lands Commission.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">According to the case of the Plaintiff/Respondent in the high court, when she purchased the land in 2005, she was given an indenture and that is what she submitted for registration to the Lands Commission. The indenture granted to Respondent acknowledged the validation of Respondent’s grantors title by the Circuit court in the law suit. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The case of the Respondent is that she also exercised acts of possession over the land by allowing a church to clear the land of bush and build facilities for worship over the land. In 2008, the 2<sup>nd</sup> Defendant/Appellant entered the land and commenced construction of a three storey building on the land. Respondent protested against this activity, and encountered land guards placed on the land to protect the agents of the Appellants while they built on the land.
