font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The brief facts as contained on the factsheet that accompanied the charge sheet are that on 25 September 2012 at about 11:41pm, the first and second accused persons together with two other persons at large attacked the complainant (PW1)<a href="file:///C:/Users/aggie/Desktop/2020-21/Criminal/Gabriel%20Donkor%20v%20Rep%20(2021_01_25%2010_26_20%20UTC).docx#_ftn2" name="_ftnref2" title=""><span class="MsoFootnoteReference"><!--[if !supportFootnotes]--><span class="MsoFootnoteReference"><span style="font-size: 12pt; line-height: 107%;">[2]</span></span><!--[endif]--></span></a> The complainant who was in charge of his vehicle Toyota Land Cruiser Prado GW 2726-12 arrived home at the main gate of his house at Dansoman Sahara, and that in the process of gaining entry in the house with assistance of his watchman at post, the accused persons (A1, A2, and two at large) armed with guns attacked the complainant and the watchman (PW2) at the gate. The accused persons shot through the windscreen and two of the tyres of the vehicle. They searched the vehicle and the complainant, took the complainant to upstairs of the house from where they took $1,000.00 dollars, GH¢500.00, a mini-laptop computer, a Samsung Galazy pad, a pistol with 25 rounds of ammunition, a couple of jewelries and fled the scene. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">Upon report to the police, A2 and A1 were arrested who mentioned A3, appellant herein as the financier and receiver of the booties from their robbery operations. In his statements to the police, the appellant is alleged to have admitted to have received the mini-laptop and others from A1 and A2 but that he had sold the mini-laptop to A4. This piece of evidence led to the arrest of A4 who admitted that indeed A3 sold the mini-laptop to him. The appellant (A3) together with A1, A2, and A4 were charged with conspiracy to commit crime, namely robbery; A1 and A2 were charged with robbery; whilst A4 was solely charged with dishonestly receiving, contrary to sections 23(1), 149, and 146 of Act 29, id respectively.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">At the trial, the accused persons including appellant denied the charges. The court convicted A1 of the counts of conspiracy and robbery; A2 was acquitted and discharged on both counts.
