A taxi driver (PW2) who was close to the crime scene responded to PW1’s SOS calls for help, pursued appellant and succeeded to arrest him, brought appellant to the crime scene, and together with PW1 sent appellant to the police who after interrogation charged appellant with the offence of robbery at the Circuit Court, Accra. In court, appellant denied the charge; he pleaded ‘not guilty’ to the offense, but at the end of trial, the court found him guilty and upheld the charge, convicted appellant and sentenced him to 10 years IHL on 26 February 2018.

<span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Arial">2.0 Grounds of the appeal

<span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">Dissatisfied with the decision of the court, appellant filed notice of appeal on 22 March 2018 seeking to set aside his conviction and sentence on the following grounds:

<span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">1<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">Judgment was unreasonable in law, considering the evidence on record

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">2<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">The reliance by the trial Circuit Court on the hospital form of PW1 when PW1 attended hospital more than one month after the alleged event is wrong in law since such was not contemporaneous with the event.

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Book Antiqua";mso-bidi-font-family:"Book Antiqua"">3<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";">&nbs
