mso-bidi-font-family:"Times New Roman"">It would appear from the accompanying statement of claim that the plaintiff entered into a contract with the defendant to purchase a property with an uncompleted structure thereon at Dome, Accra for valuable consideration. The plaintiff claims she made part payment for the said property and took possession of same. She claims she later realised that part of the written contract which she had signed were unconscionable and against her wishes because she claims she is an illiterate and that her lawyer did not explain the terms of the contract to her before she appended her signature to same.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The plaintiff claimed the defendant had threatened to sell the property to third parties because she had not been able to complete payment hence her resort to the law Court to compel the defendant to give her extension of time to complete payment and also to get parts of the contract which she considered inimical to her interest to be expunged from the terms of the contract.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The defendant filed his defence to the plaintiff’s suit and also counter claimed for certain reliefs among which was the request to the Court for the plaintiff to be ejected from the property. This relief of the defendant’s counter claim was granted by the vacation judge on the 22<sup>nd</sup> of August, 2019, when the defendant applied to the Court for an order of Summary Judgment against the plaintiff. And it is the execution of this order of summary judgment against the plaintiff which the plaintiff is seeking to stay in this present application.
