In its supporting affidavit, the 1<sup>st</sup> defendant stated that the Ghana Health Service and Teaching Hospitals Act, 1996 (Act 525) provides in section 33 of the said Act that Korle-Bu Teaching Hospital is a corporate entity with the power to sue and be sued in its corporate name and therefore the 1<sup>st</sup> defendant/applicant is not a necessary party to the present suit and so its name should be struck out on ground of misjoinder.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The 1<sup>st</sup> defendant/applicant also stated that the pleadings of the plaintiffs in their Statement of Claim do not disclose any cause of action against the first defendant and thus the presence of the first defendant in the suit is unwarranted and therefore its name ought to be struck out.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The counsel for the plaintiffs/respondents opposed the application on a point of law, saying that article 88 of the 1992 Constitution stipulates that the Attorney General is responsible for the conduct of all civil suits instituted against the state and that once the plaintiffs are seeking the enforcement of some provisions of Act 525 and which are of public interest, the first defendant/applicant being the principal legal advisor of Government should be joined as a nominal defendant to the present suit. He requested the Court to dismiss the application for misjoinder.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The Court has considered the submissions of both counsel and has also looked at the relevant sections of the Ghana Health Service and Teaching Hospitals Act, 1996, Act 525 and moreover it has adverted to its mind to article 88 of the 1992 Constitution and it is of the firm opinion that section 33 of Act 525 is clear that Korle-Bu Teaching Hospital is a corporate body that has the power to sue and be sued on its own without the involvement of the Principal Legal Advisor of Government, in this case the Attorney General.
