The defendants/respondents say that there is no truth whatsoever in the allegations of the plaintiff/applicant that the defendants are causing trouble in the church and that the plaintiff/applicant is only seeking to sow seeds of confusion in the 5<sup>th</sup> defendant church. They therefore requested the Court to refuse the application.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">It is trite to say that the order of interim injunction is essentially a discretionary remedy and the fundamental principle in the grant of such a remedy is whether or not the applicant has a legal right at law or in equity which the Court ought to protect by maintaining the status quo until the final determination of the substantive matter or action on its merits. See the case of <b>OWUSU VS OWUSU ANSAH AND ANOTHER [2007-2008] 2 SGLR p. 870.<o:p></o:p></b></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">This Court has considered the affidavit evidence of both parties and has also looked at all their annexures and the Court is of the opinion that the applicant has not shown that he has a legal right at law or in equity which the Court ought to protect pending the determination of the substantive suit. This Court is of the opinion that this present application is without merit and same ought not to be granted. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The application is thus dismissed.
