The respondent thus requested the Court to refuse the application because in his opinion the joinder of the present applicants through their lawful attorney will rather defeat the noble purpose of the trust.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Court has considered the affidavits of both parties and also the submissions of both counsel and has also adverted its mind to <b>Order 4 rule 5 (2) (b)</b> of the <b>High Court (Civil Procedure) Rules, 2004 </b>which<b> </b>gives the Court the discretion to join a party to a suit or application to ensure that all matters in controversy are effectively and completely dealt with to ensure effective and speedy adjudication of matters. The Court thinks that this is an appropriate case where the joinder, if granted, will help in the speedy and effective adjudication of the substantive application concerning the trust property. The Court therefore grants the application and orders that the four applicants herein be joined to the substantive application through their lawful attorney Aaron Akwetey Martey.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The title of the substantive application is to be amended by the original applicant to reflect the joinder.
