The applicants claim that the land in dispute forms part of a larger tract of land in respect of which the superior Courts namely the High Court, Court of Appeal and the Supreme Court have decreed various judgments in favour of the first plaintiff family.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The applicants further say that notwithstanding the said judgments, the third defendant/respondent has purportedly granted portions of the land to the first and second defendants/respondents who are fast developing same. The applicants also say that the respondents have caused massive destruction on the land by demolishing existing structures on the land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The respondents on their part have vehemently opposed the present application and have asked the Court to dismiss same for lack of merit.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">This Court has carefully considered the affidavits of both parties, including all the supplementary ones plus all the annexures/exhibits and the Court is in doubt as to whether both parties are talking about the same land. This is because while the judgments that the applicants are relying on talk about land at a place called Tesa, the respondents are also claiming that their land is situated at a place called Okpoi Gonno. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Since this Court is yet to start a trial in this matter, the Court will hesitate in granting the discretionary remedy of interlocutory injunction because the Court is in doubt as to whether the parties herein are indeed talking about the same land. This Court will therefore not grant the application for interim injunction. However, the Court orders the respondents to give an undertaking to compensate the applicants in the sum of Two Hundred Thousand Ghana Cedis (GH</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Times New Roman",serif">₵</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">200,000.00) in the event that it turns out that the respondents are not entitled to the land. The undertaking is to be filed within seven days from the date of this order.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Court also orders a Composite Plan of the land to be drawn by the Survey and Mapping Division of the Reginal Office of the land Commission to aid the Court in the identification of the land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The parties herein are to file their respective survey instructions within two weeks from the date of this order.
