According to the Plaintiff she first negotiated with the Defendant for the purchase of the building for her sister who is ordinarily resident in the United States of America (USA). The parties agree that the purchase price agreed to was </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">GH<b>¢30,000, </b>but the Plaintiff contends that there was an additional GH<b>¢2,000 </b>agreed to for the preparation of the documents.<b> </b>The </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:"Times New Roman"; mso-bidi-font-family:"Times New Roman";mso-fareast-language:EN-CA">Defendant says the Plaintiff made an initial payment of </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">GH<b>¢15,000 </b>and promised to pay the remaining balance within six months from the date of sale</span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:"Times New Roman"; mso-bidi-font-family:"Times New Roman";mso-fareast-language:EN-CA">. According to the Defendant the Plaintiff did not pay the balance of </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">GH<b>¢15,200 </b>as agreed but rather the Plaintiff paid GH<b>¢1,000 </b>after a period of ten (10) months, leaving the balance of GH<b>¢14,200. </b>It is the case of the Defendant that </span><span lang="EN-CA" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-fareast-font-family:"Times New Roman"; mso-bidi-font-family:"Times New Roman";mso-fareast-language:EN-CA">the Plaintiff continued to pay in bits and so it took her five (5) good years to complete the payment as the last payment made was in July 2014. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-CA" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-fareast-font-family:"Times New Roman"; mso-bidi-font-family:"Times New Roman";mso-fareast-language:EN-CA"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><b><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-fareast-font-family:"Times New Roman";mso-bidi-font-family:"Times New Roman"; mso-fareast-language:EN-CA">[2]</span></b><span lang="EN-CA" style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-fareast-font-family: "Times New Roman";mso-bidi-font-family:"Times New Roman";mso-fareast-language: EN-CA"> According to the Plaintiff after making the payments and renovating the house the Defendant refused to complete the sale of the house to her but was willing to sell the house to another person. The Plaintiff therefore sued to recover the purchase price of the house and the cost of renovation which she says is </span><span lang="EN-CA" style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">GH<b>¢25,680. </b>The Plaintiff also claimed interest on the amount paid for the house and also on the amount used to renovate the house together with damages for breach of contract and a restraining order. The Defendant denies the amount of money the Plaintiff claims she spent in renovating the house and also denies refusing to complete the purchase rather he contends that despite the renovation made the house was in a deplorable state and posed a serious risk to the neighbours and in particular children in the area and so he decided to demolish the house.
