It is the work done by the Plaintiff/Judgment Creditor/Respondent for the Republic of Ghana at the four stadia in Ghana (Accra, Essipong, Kumasi and Tamale) for AFCON 2008 which was won by the Pharaohs of Egypt and the non-payment of the debt which is the centerpiece of the lawsuit. I note that since the debt became due the football landscape in Africa has changed to the extent that Zambia’s national team, the Chipolopolo which had hitherto not won the continental showpiece became African Champions in 2012. Cameroon’s Indomitable Lions, the Nigeria Super Eagles, the Les Elephant de Cote D’Ivoire and the Desert Foxes of Algeria have all added to their titles by winning the AFCON but the debt has remained unpaid for the last eleven years.

<span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">

<span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">[2]<span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman""> Following a writ of summons issued at the registry of this Court, this Court on January 11, 2019 delivered a judgment in favour of the Plaintiff/Respondent herein. It is the execution embarked upon by the Plaintiff which is the subject matter of this application. The Applicant is praying for an order to set aside the Notice of Entry of Judgment filed pursuant to the judgment of January 11, 2019 and to vacate the order of attachment dated July 17, 2019. The Applicant did not premise the application on any rule of procedure as provided for in the High Court Civil Procedure Rules, 2004, C.I. 47. The Court is therefore of the view that it is anchored in the proverbial ‘inherent jurisdiction’ of the Court. The foundation of the application is that the Plaintiff/Respondent’s ‘interest rate’ applied does not reflect the Judgment granted by the Court.

<span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">

<span style="font-size: 12pt; line-height: 150%; font-family: "Book Antiqua", serif; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">[3]<span style="font-size: 12pt; line-height: 150%; font-family: "Book Antiqua", serif; background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> The Applicant filed an initial 12 paragraph affidavit in support of the application and it was deposed to by Victoria Adotey, an Assistant State Attorney.
