The Defendant then went to sleep. It failed to file a statement of defence within the time stipulated by the rules of Court. The Plaintiff therefore filed an application for judgment in default of defence. Upon service of the application on the Defendant, the latter filed its statement of defence on the 30<sup>th</sup> October, 201.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-bottom:12.0pt;text-align:justify; line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua","serif";mso-bidi-font-family:"Times New Roman"">After pre-trial settlement has broken down, parties were referred to this Court for trial. On the 4<sup>th</sup> May, 2016, the Court ordered parties to file their respective witness statements and check-lists within 21 days with a further order that the Plaintiff serve the Defendant with a copy of the said order. The records reveal that on the 11<sup>th</sup> May, 2016 the Defendant was served with a copy of the order made by the Court on the 4<sup>th</sup> May, 2016.
