On the 17<sup>th</sup> January, 2012 he caused his lawyers to issue a writ against the defendants for the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:108.0pt;text-align:justify;text-indent: -36.0pt"><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">“(i) A declaration that the vast tract of land situate, lying and being at Lotsubuer in the Dandgbe West District of the Greater Accra Region and measuring 923.062 hectares areas or 373.56 hectares and bounded on the West by Adainya family land on the north west by Maya family land and bantam kabiewe land and on the south by kabiewe land is the property of the plaintiffs.<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:108.0pt;text-align:justify;text-indent: -36.0pt"><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">(ii) Perpetual injunction restraining the defendant from wining sand on the plaintiffs family land.</span></i><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif"><o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:108.0pt;text-align:justify;text-indent: -36.0pt"><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">(iii)</span></i><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"> </span></i><i><span lang="EN-GB" style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:Tahoma">An order directed at the defendant for the reclamation of the degraded land at Lostsubuer or in the alternative cost for reclamation.</span></i><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family: "Book Antiqua",serif"><o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:108.0pt;text-align:justify;text-indent: -36.0pt"><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">(iv) Damages for trespass<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:108.0pt;text-align:justify;text-indent: -36.0pt"><i><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">(v) Costs”<o:p></o:p></span></i></p><p class="MsoListParagraph" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">On the 14<sup>th</sup> January, 2016 the 1<sup>st</sup> respondent who is one of the defendants in that suit filed a motion for interlocutory injunction against him. On the 13<sup>th</sup> June,2016 the court in its ruling which was <b><i>exhibited as “ESA 4”</i></b> granted the order of injunction by restraining the parties from developing/building on the land or alienating portions to strangers or other 3<sup>rd</sup> parties. On the 10<sup>th</sup> July, 2017 he was informed that some people were building on the land in dispute so he sent his nephews, John Ayittah and Kwesi Ayittah to go and verify whether this was true. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">According to the applicant at the various sites his nephews met one Addo Love, Abraham Tetteh, the 3<sup>rd</sup> and 4<sup>th</sup> respondents who admitted that the structures which were being developed belonged to them. Photographs of these structures according to him had be annexed to the application as<b> “ESA 5”.</b> When contacted Addo Love, Abraham Tetteh and the 4<sup>th</sup> respondent indicated that the 2<sup>nd</sup> respondent sold the land to them.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">Consequently his nephew John Ayittah informed them that the land on which they were building on was part of the land in dispute, and that the court had ordered that no building should be put on it.
