mso-bidi-font-family:Tahoma">In a nut shell the plaintiffs case is that they are owners of a Mercedes Benz Mini bus with registration number GW 8805-17 and same is operated commercially yielding daily sales of GH</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Times New Roman",serif">₵</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">250.00. On 4<sup>th</sup> August, 2017 while the vehicle was being driven and /or operated by their driver in pursuit of their commercial transport business the 1<sup>st</sup> defendant seized or caused to be seized the same vehicle without their consent or without an order from a Court and has since detained and continues to do same without authority. They contend that this has occasioned them financial and economic injury. They maintain that they neither authorized the 2<sup>nd</sup> defendant to obtain a loan facility from the 1<sup>st</sup> defendant nor use the vehicle in dispute as security for the said loan facility. Furthermore they contend that whatever charge was created in respect of the vehicle is null and void and of no effect as the said security did not comply with Section 25 of the Borrowers and Lenders Act 2008, Act 773.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">For its part the 1<sup>st</sup> defendant resists the plaintiff’s claim. Its case is that the 2<sup>nd</sup> defendant applied for and was granted a loan facility of GH</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Times New Roman",serif">₵</span><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">25, 000.00 on the 14<sup>th</sup> of September, 2016 to pay for freight charges of a Mercedes Benz Sprinter with chassis number WDB-904-463-IP-938-573. The loan facility was secured by this unregistered vehicle and another Mercedes Benz Sprinter with chassis number WDB-903-462-IP-875 with registration number GW8510-15. In addition to this it was secured by a personal guarantee of one David Agyapong. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">According to the 1<sup>st</sup> defendant it was a term of the facility granted that the unregistered vehicle shall remain in its possession until the 2<sup>nd</sup> defendant makes full and final payment of the said facility and all interest accrued thereon. Furthermore it was a term of the said facility that in case of a default on the part of the 2<sup>nd</sup> defendant it shall have the option of selling either one or both vehicles used in securing the facility to offset the loan sum and its accrued interest.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">It says that it took possession of the vehicle of the unregistered vehicle which had been illegally moved from the custody of the 2<sup>nd</sup> defendant’s mechanic.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:Tahoma">On the 13<sup>th</sup> of March, 2019 the plaintiffs filed an application for directions.
