The land acquired consisted of two plots. Plaintiff entered the land and carried out acts of possession including construction of a platform. 1<sup>st</sup> Defendant then started constructing another platform on a portion of the land which attracted an objection from Plaintiff. In view of the 1<sup>st</sup> Defendant’s impervious stance to the objections and warnings of Plaintiff, the latter was constrained to issue a Writ of Summons against 1<sup>st</sup> Defendant and sought virtually the same reliefs as being sought herein.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">The Nungua Traditional Council (NTC) then intervened in the said case and offered to mediate. The NTC was able to reach amicable resolution whereby they persuaded the Plaintiff to accept and restrict her land to one plot of 80 by 100 feet and forgo or give up the other plot of her land in favor of 1<sup>st</sup> Defendant. In addition, the NTC offered to replace Plaintiff’s second plot of land elsewhere. However, before the delegates of NTC could go unto the land to physically demarcate the land in accordance with the proposed terms of settlement, 1<sup>st</sup> Defendant went unto the land and by what he allegedly did the whole efforts by NTC came to naught. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">Indeed, it was the conduct of 1<sup>st</sup> Defendant on the land after the intervention of NTC but before the demarcation that constrained Plaintiff to file the instant action.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">Defendants denied the claim of Plaintiff and averred that 2<sup>nd</sup> and 3<sup>rd</sup> Defendants acquired the land from Nungua Stool in 1992. Interestingly, whilst Plaintiff mentioned that the land she acquired is at Okpoi-Gonno, Defendants mentioned the land to be at Baatsona-Nungua. Defendants averred that they were in peaceful possession of the land until Plaintiff came to violate their possessory rights over the land. Defendants stated that they filed an action against Plaintiff in Suit No. FAL/22/10.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 150%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">However, Defendants conceded that NTC intervened in the dispute to settle same amicably out of Court and the Council decided that Plaintiff was entitled to one plot and the Council was committed to finding her another plot elsewhere.
