He therefore averred that he was constrained to procure another grant through an indenture from the Katamanso Stool in 2003. He claims further that the said land has been plotted at the Lands Commission as confirmed by a search report dated 17<sup>th</sup> June, 2016 carried out by the Oyibi Police Station.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">Plaintiff averred further that, under similar circumstances, he has acquired interest in an adjoining land measuring 31.81 acres from the same Katamanso Stool and that this land was a subject matter of a judgment dated 18<sup>th</sup> July 2011 he obtained in his favor from the Circuit Court, Accra constituted by Her Honor Nana Adwoa Coleman (of blessed memory).<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">It is the Plaintiff’s case that 1<sup>st</sup> Defendant had trespassed by laying adverse claim to 3.92 acres of Plaintiff’s land and 2<sup>nd</sup> Defendant had trespassed by laying claim to 4.07 acres of Plaintiff’s land and both Defendants had obtained Land Title Certificates numbers TD 12293 dated 25<sup>th</sup> February 2016 and TD 12501 dated 5<sup>th</sup> May 2016 respectively.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">Plaintiff attacked the Land Title Certificates as having been obtained fraudulently and by mistake and the particulars of the fraud were stated thus:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><b><i><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">“1.
