The deed of assignment allegedly registered as No. AR/1200A/2000 covering the land was executed between Plaintiff one hand and 1<sup>st</sup> Defendant on the other hand and 2<sup>nd</sup> Defendant witnessed the execution.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">1<sup>st</sup> Defendant acquired the land from Nii Owuo-Akwaa and children by a conveyance dated 10<sup>th</sup> July 1995.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">After acquiring the land Plaintiff who lives and works in Liberia entered into possession and erected a foundation on the land through the instrumentality of 2<sup>nd</sup> Defendant. However, in the course of erecting the foundation, some people namely Davis Bortier, Abraham Adjin and Alabi Teiman entered the land and demolished the structures on two occasions and when Plaintiff informed his grantors, the Head of Nii Owuo- Akwaa family, Felix Bortier advised him to <b>settle them</b> and they were accordingly settled at a meeting by paying a sum of money to them.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">Plaintiff stated that he used the land as collateral security to secure a loan facility from UT bank and deposited the original document covering the land to UT bank and this transaction was witnessed by 2<sup>nd</sup> defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">It turned out that the 1<sup>st</sup> Defendant, after transferring the land to Plaintiff, subsequently transferred the same land to the 3<sup>rd</sup> Defendant without the knowledge of Plaintiff and 3<sup>rd</sup> Defendant engaged 2<sup>nd</sup> Defendant to work on the land. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">This portrays a bizarre situation where 2<sup>nd</sup> Defendant who allegedly was aware of the acquisition of the land by Plaintiff and actually witnessed the execution of the indenture on the land in favor of Plaintiff and was also aware of the fact that Plaintiff had secured a loan taken from UT bank with the indenture on the property turned round to work on the land for 3<sup>rd</sup> Defendant to whom the same 1<sup>st</sup> Defendant purportedly transferred the same land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">3<sup>rd </sup>Defendant has obtained Land Title Certificate over the land but Plaintiff avers that the land title certificate was issued in error or by mistake through the manipulations of the 2<sup>nd</sup> Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman"">In September 2012 when Plaintiff visited Ghana he noticed that 2<sup>nd</sup> Defendant was filling the land with sand ostensibly on the instructions of 3<sup>rd</sup> Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span lang="EN-US" style="font-family:"Book Antiqua",serif;mso-bidi-fon
