This was accompanied by a statement of claim. The Plaintiff’s claim is for a declaration of title to a parcel of land, recovery of passion of the said parcel of land and perpetual injunction against the Defendants from interfering with the Plaintiff’s enjoyment of the subject land.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">On the same day the writ was issued, the Plaintiff filed a motion on Notice for an order for interlocutory injunction to restrain the Defendants from interfering with the subject land until the final determination of the suit.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The writ of summons and accompanying statement of claim together with the motion on notice for interlocutory injunction were all served on the 1<sup>st</sup> Defendant by substituted service.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The motion for interlocutory injunction was fixed for hearing on 11<sup>th</sup> December, 2018. However Counsel for Defendant sent a letter to the court saying he had entered appearance in the action on behalf of the 1<sup>st</sup> Defendant.
