By a Certificate of Purchase dated 5<sup>th</sup> January, 2018 and issued by the Registry of this Court, title in the Property was transferred to the purchaser, Doreen Nkansah Appau (the “Purchaser”). <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-US">However, on 16<sup>th</sup> January, 2018, the Claimant herein, per its Managing Director, Michael Asiedu, filed a Notice of Claim, claiming a reversionary interest in the Property. A Notice of Proof filed by the Claimant was to the effect that on 17<sup>th</sup> February, 2012, Mr. Asiedu, acting for and on behalf of the Claimant Company executed an assignment in favour of the Defendant/Judgment Debtor for a period of Twenty (20) years within the remainder of the years granted to the said Michael Asiedu by his grantor with an option to extend the Twenty (20) year duration for a further Ten (10) years.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-US">The Claimant supported this with the Deed of Assignment attached to the Notice of Proof filed in court consequent upon the Purchaser disputing its claim. <b> </b>The Notice of Dispute filed by the Purchaser on 25<sup>th</sup> April, 2018, disputes Claimant’s claim of reversionary interest in the Property. <o:p></o:p></span></p><p class="MsoNormal" style="margin-top:12.0pt;margin-right:0cm;margin-bottom: 0cm;margin-left:0cm;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman"; mso-ansi-language:EN-US">The issue that this Court has been called upon to adjudicate is whether or not the interest of the Defendant/Judgment/Debtor in the Property, which the Purchaser obtained upon the judicial sale of the Property is subject to any reversionary interest that the Claimant holds in the Property. A reversion occurs when a property owner makes an effective transfer of property to another but retains some future right to the property.
