According to the Applicant, the subject matter of Suit No. SOL/35/10 was Bortianor stool land and the Defendants therein were grantees of the said stool. The Applicant claims that the 2<sup>nd</sup> Defendant fraudulently obtained judgment against its grantees knowing fully well that the land, subject matter of the said suit, belonged to the Bortianor stool and not to the Ngleshie Amanfrom stool. He is therefore praying the court to restrain the 1<sup>st</sup> and 2<sup>nd</sup> Defendants from dealing with the land in dispute pending the determination of the instant suit.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">In the affidavit in opposition deposed to by the Managing Director of the 2<sup>nd</sup> Defendant company, he averred that the 2<sup>nd</sup> Defendant Company, by a deed of lease dated 20<sup>th</sup> May 1995, acquired the land in dispute from Nii Kwashie Gborlor III chief of Ngleshie Amanfrom. Subsequently, the lease was registered and 2<sup>nd</sup> Defendant was issued with a land certificate on 13<sup>th</sup> August 2000. He further claimed that in 2009 the 2<sup>nd</sup> Defendant took legal action against some trespassers to its land in suit no SOL/35/10 and obtained judgment against all but the 6<sup>th</sup> Defendant, who filed terms of settlement with the 2<sup>nd</sup> Defendant. He further claimed that the Defendants who lost the case in Suit No. SOL/35/2010 have “metamorphosed” into the Plaintiffs in the instant suit to relitigate the matter. He therefore prayed that the application for injunction should be dismissed.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">In the case of <b><i><u>Wolley v Nsiah</u> (2003-2005) 1 GLR 69 at page 75</i></b>, it was held that; <o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><i><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">“an allegation of fraud against a judgment is no doubt a cause of action. It is undisputed that the person who seeks to set aside a completed judgment on the ground of fraud must come by a fresh action in the form of a writ of summons.
