He had also prayed for an order of recovery of possession and an order to restrain the Defendants therein and their assigns from interfering with Osabunya Family lands located at Old Ningo.<o:p></o:p></span></i></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></i></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The Defendant/Applicant further contended that the High Court had made an interim order in the said suit by which it affirmed the Defendant/Applicant’s grantor’s right to possession and use of the land in dispute based upon a land certificate held by the Defendant/Applicant’s grantor. He further asserted that the Defendant/Applicant’s grantor had been ordered to pay an amount of One Hundred Thousand Ghana Cedis (GH¢100,000.00) into Court as an undertaking to abide the outcome of the said suit. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">He therefore prayed the Court to strike out the instant suit as an abuse of the Court process as the issues therein were not materially different from the issues to be determined in suit no FAL/76/11.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The Plaintiff Respondent filed an affidavit in opposition to the application to strike out the instant suit. In the said affidavit in opposition, he stated that the Defendant Applicant’s grantor, Granhill Company Ltd, was incorporated in January 2016 and therefore it was not in existence at the time it purported to acquire the land in dispute from Tetteh Agbenyeke, the 1<sup>st</sup> Defendant in suit no FAL/76/11. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">He further argued that in view of the fact that the Defendant/Applicant’s vendor was not in existence at the time that suit no FAL/76/11 was filed, the interim orders made by the Court in its favour were all void.
