font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""> [1] Before me is a motion on notice filed by the 1<sup>st</sup> to 12<sup>th</sup> Defendants pursuant to Order 11 Rule 18 of the High Court (Civil Procedure) Rules, C.I 47 and the inherent jurisdiction of this Court to dismiss the Plaintiff’s suit on the grounds that the Plaintiff/Respondent has no interest whatsoever in the parcels of land the subject matter of Suit No. LD/0698/2016, hence his claim thereto has been made in utmost bad faith and is frivolous and vexatious.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[2] In the affidavit in support of the said application, the 1<sup>st</sup> to 12<sup>th</sup> Defendants Applicants averred, among others, that the Plaintiff Respondent was a grantee of the 13<sup>th</sup> Defendant against whom they had obtained judgment in Suit No. LD/0698/2016 as evidenced by Exhibit ‘ENO1’. <o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[3] They further claimed that prior to obtaining the said judgment, the 13<sup>th</sup> Defendant had caused their properties to be demolished on the basis that the land they were developing was affected by a Supreme Court Judgment entitled Adjetey Agbosu &5 others vs Ebenezer Nikoi Kotey & 3 Others that decreed title in the land in dispute in his family.<o:p></o:p></span></p><p class="MsoNoSpacing" style="margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[4] According to the 1<sup>st</sup> to 12<sup>th</sup> Defendants Applicants, acting upon this representation, they paid various sums of money to the 13<sup>th</sup> Defendant with the aim of regularizing their acquisition of their parcels of land yet the 13<sup>th</sup> Defendant caused subsequently their properties to be demolished. Eventually, they engaged a surveyor to prepare a composite plan and the result revealed that the land in dispute was not affected by the judgment based upon which the 13<sup>th</sup> Defendant had caused the demolition of their properties.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman""><o:p> </o:p></span></p><p class="MsoNoSpacing" style="margin-left:18.0pt;text-align:justify;text-indent: -18.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">[5] Based upon this revelation, the 1<sup>st</sup> to 12<sup>th</sup> Defendants caused their lawyer to issue a writ against the 13<sup>th</sup> Defendant in Suit No. LD/0698/2016 in which they claimed, among others, declaration of title to their respective parcels of land, declaration that their parcels of land do not form part of and fall outside the land the subject of the judgment in Suit No. L/2970/93 intituled Adjetey Agbosu & 5 ors v Ebenezer Nikoi Kotey & 2ors, a declaration that the demolition of parts of their properties on their respective parcels of land at the instance of the Defendant was unlawful, perpetual injuncti
