The application is premised on Order 14 rule 1 of the High Court Civil Procedure Rules, 2004 (CI 47).<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">On 28th September 2019, the Plaintiff/Applicant (hereinafter referred to as the Plaintiff) filed a writ of summons against the Defendant/Respondent (hereinafter referred to as the Defendant) for:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">a. Recovery of the sum of GHC 233,712.30 being the amount owed to the Plaintiff by Defendant by virtue of GHC 120,000 invested in the Defendant company on 19th May 2018 respectively to mature on 18th August 2018 and 18th September 2018 at an interest rate of 25% per tenure but which amount the defendant has failed to pay to the Plaintiff.<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">b. Interest on the said amounts from June 2018 and October 2018 respectively at the prevailing Commercial bank rate till date of final payment.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">c. Any further order(s) as the Court may deem fit.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Counsel for the Plaintiff in this application relied on the motion paper, affidavit in support and all the annexures as well as all processes filed in this suit. Counsel submitted that the defence filed on behalf of the defendant does not reveal any reasonable defence to the claim and for that matter no useful purpose will be served by going into a full trial of the matter.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Defendant is opposed to the application and has demonstrated it in an affidavit in opposition filed on 24<sup>th</sup> April, 2019. It was deposed in the affidavit in opposition that the application is premature and therefore ought to be dismissed.The Defendant and its lawyer, however, failed to appear in court when the motion was moved by counsel for the Plaintiff. This is in spite of the fact that hearing notice was served on them.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">Order 14 rule 1 of CI 47 provides: <o:p></o:p></span></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><i><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif">“Where in an action a defendant has been served with a statement of Claim and has filed an appearance, the plaintiff may on notice apply to the Court for judgment against the defendant on the ground that the defendant has no defence to a claim included in the writ, or to a particular part of such a claim, or that the defendant has no defence to a claim or part of a claim, except as to the amount of any damages claimed.”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The legal principles relating to application for summary judgment are also settled in numerous judgments of the court which set out those principles.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;text-indent:36.0pt;line-height: 115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">An aggrieved person and his adversary have the right to access to court and with it the right to have their day in court. Hence, case laws dictate that the court should only exercise its power to enter judgment without a trial provided the plaintiff can proof his or her claim clearly by affidavit evidence. The following conditions must, however, be fulfilled prior to the entry of summary judgment:<o:p></o:p></span></p><p class="MsoNormal" style="margin-left:72.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">1.
