A Nolle Prosequi was filed in respect of the Second Accused and he was eventually used as a prosecution witness.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:311.25pt"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif"> </span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:311.25pt"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif">FACTS: <o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:311.25pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The facts of the case were provided by the Prosecution as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:311.25pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">On the 22<sup>nd</sup> of August, 2006 at about 2.00am, passengers travelling to and from the Kunsu Wiaso road which is located at Domeabra on the Kumasi-Tepa highway, at about 2 am were attacked by a group of about 5 persons who were armed. They blocked the road and stopped all the approaching vehicles from both sides of the road and ordered the drivers to stop and the passengers to get down, at gun point. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%;tab-stops:311.25pt"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">One of the drivers of a Benz bus called Kofi Boadi who attempted to run away was shot in the waist by one of the robbers. One Nicholas Mensah a passenger was also stabbed on the mouth with a knife. The robbers were able to steal various items from the victims after which they bolted away. The Policemen on duty at the Bechem, Kumsi highway checkpoint, at about 7am in the morning intercepted an Opel Astra taxi cab with registration No. GT 9968 B driven by the 2<sup>nd</sup> accused, Stephen Aniglo with 2 other passengers, one of them being the 1<sup>st</sup> accused, Hammah Mohammed and one other Shaibu Osumanu. The Police intercepted the taxi because it was not having a valid insurance policy, and started interrogating the 2nd accused<sup> </sup>who was the driver. In the process one of the passengers, Shaibu Osumanu took to his heels, which made the Police suspicious. The first accused also attempted to run away, but after a hectic struggle the Police were able to over-power him, then the two of them were arrested and the vehicle was searched. The Police found the following in the black bag in the vehicle: 2 unregistered short guns, one sharp kitchen knife, 5 torch lights, Nokia 3310 mobile phone, 4 pieces top-mark universal BB cartridge, one quart comfy unit watch, one Yachica Camera, 2 pocket note books, one used lomani perfume, one broken short gun barrel, and cash sum of ¢5,062,000.00 old cedis. The accused persons were interrogated and they couldn’t give any reasonable explanation as to how they came into the possession of such items.
