text-align:justify;text-indent:-54.0pt;line-height:115%"><i><span style="font-family:"Book Antiqua",serif">“(a) a declaration that the defendant’s treatment of the plaintiff amounted to a violation of the economic rights of the plaintiff guaranteed under the 1992 Constitution.<o:p></o:p></span></i></p><p class="MsoNormalCxSpMiddle" style="margin-left:72.0pt;mso-add-space:auto; text-align:justify;line-height:115%"><i><span style="font-family:"Book Antiqua",serif"> </span></i></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><b><u><span style="font-family:"Book Antiqua",serif">BACKGROUND FACTS<o:p></o:p></span></u></b></p><p class="MsoNormalCxSpMiddle" style="text-align:justify;line-height:115%"><span style="font-family:"Book Antiqua",serif">The Appellant was employed by the Respondent by the letter of employment dated 23<sup>rd</sup> July 1985 (see page 173 of the Record of Appeal), which letter contained conditions of Appellant’s employment including his classification as an Assistant Agricultural Development Officer. The Respondent decided to transfer the Appellant to mainstream banking when it came to the attention of the then Managing Director, that the Appellant had almost completed the final examination of the Chartered Institute of Bankers, United Kingdom. The letter of transfer was dated 13<sup>th</sup> July 1995. The Respondent organized an internal training program for the Appellant. The Appellant was given signatory “B” signing powers/status and signatory “A” signing powers/status after training.
