He was issued with a receipt as well as a Deed of Assignment. According to the Plaintiff, before he purchased the property in contention he made a search at the Lands Commission, Sekondi through his lawyer Mr. Amaning. The search report revealed that the said Chief Emamor was the owner of the property by virtue of a lease executed between him and the Government of Ghana. According to the Plaintiff, the property was in a very poor state of disrepair so he gave notice to all the tenants in the house including the Defendants<i> </i>to quit from the house for him to demolish and reconstruct a new house on the land. He obtained a permit from Sekondi/Takoradi City Council to do so. Some of the tenants left the house but the Defendants herein refused to do so. According to the Co-Defendant Chief Ogor Emamor whom Plaintiff claims sold the house to him was an administrator together with the late Jijala Kpikpi to the estate of the deceased, Mary Makpoley. She relied on a judgment of the Circuit Court, Takoradi in support of her case that the house in question belonged to the said Mary Makpoley.
