The Notice of Appeal was filed on 27<sup>th</sup> August 2010 with four substantive grounds of appeal. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: "Times New Roman""><o:p> </o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span lang="EN-GB" style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri; mso-bidi-font-family:"Times New Roman";mso-ansi-language:EN-GB">Although neither lawyer in this appeal raised the issue of the competency nor otherwise of the Notice of appeal, it is obligatory for an appellate court in every appeal to ascertain that its jurisdiction has been properly invoked. </span><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-fareast-font-family:Calibri;mso-bidi-font-family:"Times New Roman"">The court has a duty whenever it is of the opinion that an appeal was filed out of time to raise and discuss it</span><span style="font-size:12.0pt;line-height: 150%;font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri; mso-bidi-font-family:"Times New Roman";mso-ansi-language:EN-GB"> <span lang="EN-GB">since </span></span><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-fareast-font-family:Calibri;mso-bidi-font-family: "Times New Roman"">the time within which to file an appeal is a crucial issue that goes to jurisdiction.
