That the said deceased Theresa Addo-Quaye again purchased the <i>res litiga</i> on the 14<sup>th</sup> of July, 1978. And with that Theresa Addo-Quaye went into immediate possession by erecting temporary structures and also put some mechanics on part of the land. And it was not until December, 2009 that Defendant sent a letter to their licensees to vacate the land which was followed by an unauthorized dumping of sand and stones by the Defendant. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-ansi-language:EN-US"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-ansi-language:EN-US">The Defendant on the other hand maintained that his family made a gift of 0.19 of an acre of land in 1975 to the mother of 1<sup>st</sup> Plaintiff and 0.22 acre of land to one S. Lawson. That his predecessor, Daniel Seth Botchway inadvertently gave the land of Lawson to Theresa Addo-Quaye. The family upon realizing this mistake gave a different land to the deceased Theresa Addo-Quaye which she has been occupying till her death and has passed on to her children. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-ansi-language:EN-US"><o:p> </o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-ansi-language:EN-US">After a full trial the learned trial Judge dismissed the claims of the Plaintiffs and entered judgment for the Defendant.
