Upon service of the notice of appeal on the Plaintiffs, they also filed a cross - appeal on 18th August, 2014.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size: 12pt; line-height: 150%; font-family: "Book Antiqua", serif;"><br> <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The brief facts of the case which culminated to this appeal were that the Plaintiffs were part of the police officers who were compulsorily retired by the Ghana Police Service between 1993-1994 on the premise that they had attained compulsory retiring age of fifty and fifty-five years for police women and policemen respectively.</span><br> <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;">The retiring ages for members of the Ghana Police Service before the coming into force of the Constitution of Ghana, 1992 were fifty and fifty years for women and men respectively. On the coming into force of the Constitution on 7th January, 1993, the Ghana Police Service continued to retire its female and male officers and men under the then existing enactment.<o:p></o:p></span></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size: 12pt; line-height: 150%; font-family: "Book Antiqua", serif;"><br> <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> Some of the affected police officers filed a suit at the Supreme Court for a declaration that by true and proper interpretation of Article 199 (1) of the Constitution of Ghana, 1992, Police Officers were public officers and supposed to retire at 60 years and sex was immaterial. The Supreme Court in different suits declared the police officers who were made to compulsorily retired at 50 and 55 years respectively as unconstitutional and therefore a nullity. One of the Supreme Court's decisions entitled Mr. C.B. Bawuah v Attorney- General and Inspector- General of Police was delivered on 26th July, 1994 and declared the compulsory retiring ages of 50 and 55 years for women and men respectively as unconstitutional.<o:p></o:p></span></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size: 12pt; line-height: 150%; font-family: "Book Antiqua", serif;"><br> <span style="background-image: initial; background-position: initial; background-size: initial; background-repeat: initial; background-attachment: initial; background-origin: initial; background-clip: initial;"> The Plaintiffs who were 131 affected officers of the Ghana Police Service instituted an action in the High Court Accra on 27th April, 2006 which culminated to this appeal.
