The trial High Court in the Ruling granted leave to the Plaintiff /Respondent to amend its Writ of Summons and Statement of Claim after trial had ended and the Defendant had filed his written address. The relief sought from the Court of Appeal is for an order to reverse the ruling of the High Court dated 23<sup>rd</sup> November 2018.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">The facts antecedent to the appeal are that the Plaintiff/Applicant/Respondent who will be referred to alternately as Plaintiff or Respondent filed this writ on 15<sup>th</sup> April 2014 against the Defendant/Respondent/Appellant who will be alternately referred to as Defendant or Appellant for the following reliefs:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">a: Declaration that activities of Defendant on Plaintiff’s land amounts to trespass.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">b. Recovery of possession of the said two plots measuring 140 feet by 100 ft (0.32 Acre) and further order to demolish any offending structures placed and erected on Plaintiff’s land by Defendant at cost to Defendant.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">c.
