J.A:<o:p></o:p>The
plaintiff/respondent’s claim he put before the Circuit Court was for <o:p></o:p>“a. &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A
declaration of title to and recovery &nbsp;of
possession of all&nbsp;&nbsp;&nbsp; that&nbsp; cocoa farm situate&nbsp; and being at KYINKYIRISU at Bokuruwa&nbsp; on&nbsp;
Sabronum stool&nbsp; land and&nbsp; bounded by&nbsp;
the farms&nbsp; of Mr. Adade&nbsp; (deceased) now succeeded by Osei Duodu, ama
Buor&nbsp; and the&nbsp; stream Kyikyirisu.<o:p></o:p>b.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Damages for trespass.<o:p></o:p>c.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Perpetual
injunction of restraining the defendant, her relatives, agents/servants from
having any dealings with the said farm”.<o:p></o:p>And
a counterclaim by the defendant/appellant was for:<o:p></o:p>“1. A

restraining the plaintiff, her agents, assigns and workmen from&nbsp; having anything&nbsp; to do with&nbsp;
cocoa farm in dispute”.<o:p></o:p>We
will refer to the parties as they were designated at the trial court:
plaintiff/respondent as plaintiff and defendant/appellant as defendant.<o:p></o:p>After
trial the circuit judge gave judgment for the plaintiff for all the reliefs
endorsed on the writ. The defendant/appellant is aggrieved by this judgment and
is in this court seeking a second opinion whether the trial judge’s opinion
should stand. He has identified 6 areas he prays this court should guide itself
with in our rehearing exercise, an exercise which an appeal statutorily
entails. These 6 areas he has formulated as his grounds of appeal are<o:p></o:p>“a.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; 
The judge erred by failing to recognize that Plaintiff’s action was incompetent
for want of capacity to claim property of a deceased person without Letters of
Administration (L.A) granted her or Vesting Assent executed in her favor.<o:p></o:p>b.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The
Judge erred by presuming the validity/authenticity of the document (Exhibit A)
against Defendant when the authenticity of the said document was disputed&nbsp; and same was set as issue for trial.<o:p></o:p>c.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The
Judge misdirected herself on the burden of proof which misdirection resulted in
unjust decision against the Appellant.<o:p></o:p>Particulars
