ASIEDU, JA.<o:p></o:p></span></i></b></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The instant motion is a repeat application by the Plaintiffs/Appellants/Applicants (hereinafter referred to as the Applicants) for “an order staying the execution of the judgment and any orders delivered and made by the High Court on 22<sup>nd</sup> day of February 2019, pending the hearing and determination of the Appeal filed before the Court of Appeal, Kumasi”. The motion is supported by an affidavit. The Defendants/Respondents/Respondents (hereinafter referred to as the Respondents) are opposed to the application as shown by their affidavit in opposition.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The Applicants have deposed that their suit against the Respondents was dismissed by the High Court, Kumasi on the 22<sup>nd</sup> February 2019 which went ahead to enter judgment in favour of the Respondents on their counterclaim. Aggrieved by the judgment of the High Court, the Applicants, on the 28<sup>th</sup> February 2019, filed a Notice of Appeal which has been exhibited hereto as exhibit ‘A’ and later Additional Grounds of Appeal on the 15<sup>th</sup> October 2019 exhibited as exhibits A(i) and A(ii) respectively.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">As already indicated, the instant motion is a repeat application before this Court since the High Court, on the 28<sup>th</sup> July 2020, dismissed an earlier application for stay of execution filed by the Applicants herein.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The Respondents have deposed in paragraph 9 of their affidavit in opposition that “the execution processes have been completed” and that “basically there is nothing to stay” for which reason they say, “the present application is moot or dead on arrival”. The Respondents have exhibited exhibits NA1, NA2 and NA3 in support of their deposition. Exhibit NA1 is a ruling by the High Court which dismissed an application filed by the Applicants for an order to set aside the Entry of Judgment filed by the Respondents on the 17<sup>th</sup> July 2019. Exhibit NA2 is a Praecipe of Writ of Possession filed by the Respondents on the 24<sup>th</sup> January 2010 whiles exhibit NA3 is the ruling delivered by the High Court on the application for stay of execution.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:150%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">From exhibits NA1 and NA3, it is clear that the Applicants filed their motion for stay of execution before the High Court on the 28<sup>th</sup> February 2019 and same was served on the Respondents in June 2019. Hitherto, the Notice of Appeal had been served on the Respondents in March 2019. Thus, the Entry of Judgment filed by the Respondents on the 17<sup>th</sup> July 2019 was filed well after the application for stay of execution had been served on the Respondents.
