This is based on the legal principle of reciprocity or mutuality of contracts which is to the effect that whatever one party to a contract can do, the other party should be able to do likewise. If the principle of mutuality were not to apply, it would mean that the contract would be unbalanced and would be seen to be tilted in favour of one party to the detriment of the other. One could imagine what the situation would be like if the employer were to have the power to terminate the employment contract at will without the employee being able to do likewise by resigning whenever he liked.

<span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New"">

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">The problem however is that most often whereas employees always feel it is their right at will and in fact take it for granted, they see it as a taboo for employers to do likewise.”

<span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New"">

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">It is against the backdrop of the above quotation that I propose to discuss the instant case before me.

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">

<span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-fareast-font-family:"Book Antiqua"; mso-bidi-font-family:"Book Antiqua"">2.<span style="font-variant-numeric: normal; font-variant-east-asian: normal; font-weight: normal; font-stretch: normal; font-size: 7pt; line-height: normal; font-family: "Times New Roman";"> <span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New"">THE DECISION

<span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Courier New"">

<span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New"">Let me at this juncture state, without any equivocation, that the plaintiff herein is not entitled to the reliefs he seeks from this Court because he has failed to discharge the onus placed on him to show that the termination of his employment by the defendant is wrongful and that he is consequently entitled to the award of damages for wrongful termination.
