The lease in respect of the said land was for a period of fifty (50) years commencing from 1<sup>st</sup> July, 2004. Later on in the year 2005 the Ghana Highway Authority notified property and land owners in that area that the Government of Ghana intended to carry out an extension of the motorway from the Tetteh Quarshie Roundabout through Apenkwa to the Mallam Junction.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:0cm; margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New";mso-ansi-language:EN-US"> </span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:0cm; margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New";mso-ansi-language:EN-US">The plaintiff was duly notified by the Ghana Highway Authority because the land he bought from Mark Obiri happened to fall within the area earmarked for the extension of the motorway.<o:p></o:p></span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:0cm; margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New";mso-ansi-language:EN-US"> </span></p><p class="MsoNormal" style="margin-top:0cm;margin-right:0cm;margin-bottom:0cm; margin-left:36.0pt;margin-bottom:.0001pt;text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Courier New";mso-ansi-language:EN-US">The Ghana Highway Authority thereafter marked a portion of the plaintiff’s building which he had erected on the plot of land and same was demolished together with other properties belonging to different land owners to make way for the extension of the road from Tetteh Quarshie to Mallam. At the time of the demolition the plaintiff was in the United Kingdom (UK) and he later returned to Ghana to find the defendant carrying on the business of selling used vehicles on the portion of his land that was not affected by the road extension.
