The reason for this request is that the property in issue which is described as Hse n<u>o</u> D733/4 and which is said to be situate on the Boundary Road, Ussher Town, Accra is part of the estate of the late Jacob Asamani Boateng. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The plaintiffs/applicants who are the administrators of the estate of the late Jacob Asamani Boateng claim that they have been in possession of the said property until the defendants interfered with the said possession by placing tenants in the said property. The applicants also claimed that the defendants are committing waste by making alterations to the property and that if the defendants are not restrained, they will totally change the character of the property before the substantive matter is determined on its merits and if that happens, no quantum of damages will be adequate as compensation to the plaintiffs. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The defendants/respondents are opposed to the application for the reasons that the property is part of the estate of one Thomas Jonas Aryeetey and that same was the self-acquired property of the said Thomas Jonas Aryeetey and that the plaintiffs/applicants were rather laying an adverse claim to the said property. The defendants say that they are in effective possession of the property in dispute and that the said property is in serious disrepair and therefore needs urgent renovations to be carried out on same to prevent it from collapsing on innocent traders and pedestrians who ply the street in front of the property in the course of their daily business activities.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">The Court has considered all the affidavits and exhibits annexed by both parties and the Court is of the opinion that this application ought not to be granted because the affidavit evidence show that it is the defendants who are in control of the disputed property and they (especially the 1<sup>st</sup> to 3<sup>rd</sup> defendants) have been summoned to the Sanitation Court of the Accra Metropolitan Assembly in order for them to renovate the property since same has fallen into serious disrepair. A grant of this application will only serve the purpose of halting or delaying the process of renovations which the property is in dire need of to save it from collapsing on and killing innocent Ghanaians. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify"><span lang="EN-GB" style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif">In the light of the above reasoning this Court believes that the application is without merit and so same is refused.
