The court has also received affidavit in opposition filed on 11<sup>th</sup> December, 2019 by the defendants in this matter.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">It is the position of the law that in consideration of an application pursuant to order 25 of CI 47 the court takes into account its old principles as set out in the case of <b>American Cyanamid vs Ethicon 1975 </b>appeal cases. The first issue for consideration by the court is without of not the predicate writ can be described as frivolous or vexatious having peruse the writ and the statement of claim the court is of the opinion that there is a legitimate cause of action or triable issue. The court has also given consideration to the various position posited by both plaintiffs and the defendants and has taken the view backed by law that conflicting claims in terms of title do not in themselves serve as a Bar to the grant of an order 25 application. The essence of an order 25 (1) application has been stated in the Ghanaian case of <b>Owusu vs Owusu Ansah</b> decided by <b>Adinyirah JSC</b> as he then was. The same principles were stated in the Nigerian case of <b>7 up bottling company limited vs Abiola & Sons Ltd 1995 3NWLR </b>decided by<b> Adio JSC </b>stating it as primarily to preserve the status quo pending the determination of the suit.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%; font-family:"Book Antiqua",serif">It is trite that a court cannot on the authority of <b>Vanderpuye vs Nartey 1977 GLR</b> make any findings of fact in this matter. However, the court turns its attention to matters concerning balance of convenience and issues of hardship. It is clear from the documentation before the court that despite the conflicting interest and the assertion that there are no tenants on the property a look at the photographic evidence attached to the substantive 25 (1) application and marked as exhibit AB (3) show clearly shops locked up.
