Mr. Kofi Boakye of Regal Manna Chambers first entered appearance for the 1st Defendant on November 7, 2016 and on January 31, 2017 also entered appearance for the 2nd Defendant. On February 8, 2017 a joint Statement of Defence was filed by Mr. Boakye for the Defendants. Counsel for the Plaintiff on July 14, 2017 filed a reply to rebut the averments contained in the statement of defence filed. An application for Directions was also filed on the same July 14, 2017 by Plaintiff’s Counsel. The Defendants Counsel on November 3, 2017 filed Additional Issues and raised four issues for the Court’s determination. On November 6, 2017 the Court set down the issues set out in the Plaintiff’s Application for Directions together with the Additional Issues and ordered the parties to file their witness statements with their exhibits. <o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman""> </span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><b><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">[2]</span></b><span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman""> The parties complied with the order and filed their witness statements in 2018 and a trial date was set. The trial did not proceed and a new trial date was set but that was also not utilized because on August 3, 2019 the 1st Defendant passed. The matter has since stalled because Counsel for the Defendants has since the demise of the 1st Defendant not substituted him. The Instant Application</span></b><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">:<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><b><span style="font-size:12.0pt;line-height:150%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">[3]</span></b><span style="font-size: 12.0pt;line-height:150%;font-family:"Book Antiqua",serif;mso-bidi-font-family: "Times New Roman""> Counsel for the Plaintiff has therefore brought the instant application for an order to substitute the deceased 1st Defendant with one Kwabena Amo, the customary successor of the deceased. According to the Applicant though her lawyer has notified the Defendants’ Counsel to substitute the deceased he has failed to comply. According to the Applicant, following the death of the 1st Defendant, “the family of the deceased selected one Kwabena Amo of Akim Achiase as the customary successor of the deceased”. The Applicant has further deposed that she has been advised and she believes same to me true that “the customary successor of the 1st Defendant is the most appropriate person to be made to substitute the 1st Defendant in this matter” in his capacity as the customary successor. It is also the case of the Applicant that there is the need for the substitution to be granted because she is advised and believe same to be true that without the substitution the matter cannot proceed following the death of the 1st Defendant. Based on the depositions, the Plaintiff/Applicant is praying for an order to substitute the 1st Defendant with his customary successor.<o:p></o:p></span></p><p class="MsoNormal" style="margin-bottom:0cm;margin-bottom:.0001pt;text-align: justify;line-height:150%"><span style="font-size:12.0pt;line-height:150%; font-family:"Book Antiqua",serif;mso-bidi-font-fam
