The application is supported with a 25 paragraphed affidavit of one Patrick Nakai-Nelson, a Principal Records Officer at the Legal Department of the 1st Applicant. Counsel for the Plaintiff/Respondent was served with the application instead of the Plaintiff herself. On March 11, 2020 Mr. Ken Anku Esq. who is the Counsel of record of the Plaintiff deposed to a 17 paragraph Affidavit in Opposition. Counsel anchored his objection in Section 26 (2) of the Legal Profession Act, 1960, Act 32. Counsel referred to the law and submitted that the Notice of Appointment of Mr. Mensah Akrong as a new lawyer for the Defendants/Applicants is defective. Counsel submitted that the application for stay of execution is contingent upon the Notice of Appeal filed on 28/01/2020 but the notice of appointment of Counsel as a new lawyer was filed on 18/2/2020.
