Pursuant to this on 27<sup>th</sup> of April, 2017 the Plaintiff entered into a loan agreement with the Defendant. The Defendant was to repay the facility together with interest at the rate of 30% per annum computed using the straight line method for a period of 36 months with effect from 28<sup>th</sup> of June, 2017 to 28<sup>th</sup> of May, 2020. As security for the loan the Defendant gave his house at Teiman to the Plaintiff. The provision of security was the material inducement for which the Plaintiff gave out this loan to the Defendant. On 24<sup>th</sup> of July, 2017 the Defendant wrote to the Plaintiff for an additional loan facility in the sum of GHC20, 000.00 making his total liability to the Plaintiff GHC198, 240.00.<o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;text-justify:inter-ideograph; line-height:115%"><span style="font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="text-align:justify;text-justify:inter-ideograph; line-height:115%"><span style="font-family:"Book Antiqua",serif">In pursuance of this request by the Defendant on 28<sup>th</sup> of July, 2017 the Plaintiff entered into a loan agreement with the defendant wherein it granted the Defendant the additional loan facility of GHC 20,000.00. The Defendant was to repay the facility together with interest thereon at the rate of 30% per annum completed using the straight-line method and make a monthly payment of GHC10, 462. The Defendant utilized the facility and has failed to honour his obligation by paying off the full loan. According to the Plaintiff it caused its lawyers to write a final demand letter to the Defendant dated 23<sup>rd</sup> of January, 2020. The Defendant paid an amount of GHC 50,000.00 out of the total debt owed. This attracted an additional penalty of GHC21, 880.21. It is the contention of the Plaintiff that the time limited for paying the loan has long elapsed and all efforts to get the Defendant to settle his indebtedness have proved futile. It says that as at 28<sup>th</sup> of May, 2020 the Defendant’s outstanding balance was GHC 380,321.07. <o:p></o:p></span></p><p class="MsoNoSpacing" style="text-align:justify;text-justify:inter-ideograph; line-height:115%"><span style="font-family:"Book Antiqua",serif"> </span></p><p class="MsoNormal" style="mso-margin-top-alt:auto;mso-margin-bottom-alt:auto; text-align:justify;text-justify:inter-ideograph;line-height:115%"><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">T</span><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:Arial">he Defendant failed to file an affidavit in opposition although he was served with the present application. This does not mean however that the Plaintiff would be automatically entitled to the order or judgment sought. </span><span style="font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">The purpose of Order 14, rule 1 of the rules of Court is to enable a Plaintiff to obtain Summary Judgment without trial, if he can prove his claim clearly. </span><span style="font-family: "Book Antiqua", serif;"> <o:p></o:p></span></p><p class="MsoNormal" style="mso-margin-top-alt:auto;mso-margin-bottom-alt:auto; text-align:justify;text-justify:inter-ideograph;line-height:115%"><span style="font-family: "Book Antiqua", serif;">From the affidavits and exhibits filed the Plaintiff’s case can be described as clear enough.
