The grounds of the application and the arguments advanced by Counsel for Applicant are twofold and can be neatly summed in paragraphs 8, 9 and 10 of the affidavit in support of the motion for joinder. They are as follows:<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">“ 8<i>. In the probated Will of the deceased he appointed his eldest daughter, the said Ama Yetunde Nicola Kwabwe (nee Zwennes) as a Third Executrix & Trustee to his estate to act in the stead of either the 1<sup>st</sup> Defendant or myself in the event of either of us being unable to do so.<o:p></o:p></i></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">9. That the third executrix, my eldest sister is also a beneficiary under the Will and is hereby gravely concerned in these proceedings and in the outcome of the instant suit which has been brought against her mother and i.<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">10. That I repeat paragraph 9 above and say that the joinder to this probate action of Ama Yetunde Nicola Kwabwe (nee Zwennes) as Third Executrix, Trustee and beneficiary to the estate of the deceased is necessary to ensure that all matters in the proceedings are effectively and completely determined and adjudicated upon with finality”<o:p></o:p></span></i></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">This application has been opposed by Counsel for the Plaintiffs/Respondent and he argues that the rule on joinder talks about the fact that the party who seeks to join must be a necessary party to the action. Such a necessary party’s inclusion would ensure that the matters in controversy are final and effectually disposed of. The executor and executrix have been sued in respect of the estate matter. Once the Executor is sued they answer for all the beneficiaries. <o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><b><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">Court’s Analysis<o:p></o:p></span></b></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">I will therefore examine the practice and procedure under the Rule invoked.<o:p></o:p></span></p><p class="MsoNormal" style="text-align:justify;line-height:115%"><i><span style="font-size:12.0pt;line-height: 115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">Order 4 Rule 5 (2) (b) of C.I 47 provides as follows<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;text-indent: -36.0pt;line-height:115%"><i><span style="font-size:12.0pt;line-height:115%;font-family:"Book Antiqua",serif; mso-bidi-font-family:"Times New Roman"">“(2) At any stage of proceedings the Court may on such terms as it thinks just either of its own motion or on application<o:p></o:p></span></i></p><p class="MsoNormal" style="margin-left:36.0pt;text-align:justify;line-height: 115%"><i><span style="font-size:12.0pt; line-height:115%;font-family:"Book Antiqua",serif;mso-bidi-font-family:"Times New Roman"">(b) order any party who ought to have been joined as a party or whose presence before the Court is necessary to ensure that all the matters in dispute in the proceeding are effectively and completely determined and adjudicated upon to be a
